Disability Claim Process

When you develop a medical condition that prevents you from working, you might consider filing a long-term disability (LTD) claim.  The claim process, however, can be complex.  In fact, many professionals have a long-term disability policy but may not fully understand what the claims process entails.

If you are unable to work and decide to file a claim for disability benefits, there are a few first steps you must take, including:

  • Submitting a notice of claim to the insurance company;
  • Filling out and submitting all claim forms, including the claimant statement, attending physician statement, and employer statement;
  • Submitting evidence, such as medical records and witness statements, to prove your disability under your policy’s definition of disability.

When you file an initial claim, you must be cognizant of deadlines.  Every item you submit has a deadline, and if you miss one of these deadlines the insurance company could issue a denial of your claim.

Insurance Companies Investigate Your Initial Claim

Once you submit your claim forms and evidence, your insurance company will begin investigating your claim.  It is important to remember that insurance companies do not want to pay claims, so they will try and find a reason to deny your benefits.

To investigate your claim, your insurer may use some of the following methods:

  • Conduct “file reviews” on a claimant’s medical records;
  • Request independent medical exams (IMEs);
  • Use surveillance tactics; and
  • Monitor claimants’ social media accounts.

After this evaluation is complete, the insurance company will issue either an approval or a denial of your claim.
